Welcome to Ahabali.com, operated by Aha Bali Tour.

These Terms and Conditions govern your use of the Website and the booking and use of the tours, travel services, and other related services that we provide.

By accessing the Website, making a booking, or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with these Terms, please do not use the Website or our services.

1. Definitions

  • “Services” means tour packages, private trips, transportation, accommodation, liveaboard trips, and other travel-related services offered by Aha Bali Tour, including but not limited to tours to Bali, Komodo, Nusa Penida, Raja Ampat, and Java.
  • “Booking” means a reservation request for Services submitted by a Guest through the Website, email, WhatsApp, or another official communication channel.
  • “Booking Confirmation” means written notification from us confirming that a Booking has been received and approved.
  • “Third-Party Service Provider” means a third party, such as an airline, hotel, liveaboard or boat operator, restaurant, local guide, or other provider that works with us in delivering the Services.

2. Bookings and Confirmation

  1. Bookings may be made through the Website, by email at info@ahabali.com, or by WhatsApp at +62 811-3992-2788.
  2. A Booking becomes binding only after we have issued a written Booking Confirmation and received the required payment, whether a deposit or full payment, according to the applicable terms.
  3. Guests must provide complete and accurate information at the time of Booking, including:
    • Full name as shown on a valid identification document or passport;
    • Number of participants;
    • Travel dates;
    • Special requirements; and
    • Relevant health information.
  4. We reserve the right to reject or cancel a Booking if the Service has reached full capacity or if there is an indication that the information provided is false, inaccurate, or misleading.

3. Prices and Payments

  1. All Service prices are stated in the specified currency, which may be Indonesian Rupiah (“IDR”) and/or United States Dollars (“USD”). Prices may change at any time before a Booking Confirmation is issued.
  2. Payments may be made by bank transfer, credit or debit card, payment link, or another payment method made available at the time of Booking.
  3. Unless otherwise agreed in writing, we may require an advance deposit to secure the Booking. The remaining balance must be paid before the departure date according to the payment schedule provided to the Guest.
  4. A confirmed price will not change unless there is a significant change beyond our control, such as an increase in fuel costs, taxes, government fees, or changes in government policy. Any such change will be communicated to the Guest as soon as reasonably possible.

4. Cancellation and Schedule Change Policy

  1. Any cancellation by the Guest must be submitted in writing through our official email address or WhatsApp number.
  2. Cancellation charges may apply depending on how far in advance the cancellation is made before the departure date. The specific cancellation terms for each package will be provided at the time of Booking Confirmation.
  3. Deposits are generally non-refundable, except where cancellation is caused by our failure to provide the Services.

    In the event of cancellation due to bad weather, any refundable amount will be calculated after deducting the costs already charged or retained by Third-Party Service Providers from the time the Booking was made.

  4. If a Guest cancels after making full payment, a cancellation charge of up to 100% of the total payment will generally apply, and the payment may be fully non-refundable.
  5. We reserve the right to change the schedule, route, or components of the Services due to circumstances including, but not limited to, weather conditions, safety considerations, or policies imposed by local authorities.

    We will notify the Guest of such changes as soon as reasonably possible and will offer a reasonable alternative where available.

5. Force Majeure

We are not responsible for any delay, change, disruption, or cancellation of the Services caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters;
  • Extreme weather;
  • Unsafe sea conditions;
  • Government regulations or policies;
  • Pandemics or disease outbreaks;
  • Civil unrest;
  • Strikes;
  • Transportation disruptions; or
  • Other events that cannot reasonably be prevented or controlled.

In such circumstances, we will make reasonable efforts to provide an alternative solution or compensation in accordance with the applicable policies. However, we do not guarantee a full refund.

Any refund or compensation may depend on the policies of the relevant Third-Party Service Providers and the amount that can be recovered from them.

6. Guest Obligations and Responsibilities

Guests are required to:

  • Follow all safety instructions provided by guides, boat crews, drivers, or our staff during the trip;
  • Ensure that their health and physical condition are suitable for the booked activities, including activities such as snorkeling, trekking, and sea travel;
  • Hold valid and current travel documents, including identification documents, passports, visas, and travel insurance where required;
  • Take responsibility for their personal belongings during the trip; and
  • Behave respectfully and observe local culture, customs, traditions, and environmental regulations throughout the tour.

Guests must inform us before departure of any medical condition, allergy, pregnancy, mobility limitation, or other condition that may affect their ability to participate safely in the Services.

7. Limitation of Liability

We make reasonable efforts to provide the Services to a high professional standard.

However, to the fullest extent permitted by applicable law, we will not be responsible for any injury, loss, damage, expense, delay, or other loss arising from:

a. The Guest’s own acts, omissions, or negligence;

b. The actions, omissions, or failure of a third party outside our reasonable control;

c. A force majeure event as described in Section 5; or

d. Risks that are inherent in nature-based tourism, water activities, sea travel, snorkeling, trekking, and other outdoor activities.

Where our liability is legally established, our liability will be limited, to the extent permitted by law, to the amount paid to us for the relevant Service that gave rise to the claim.

Nothing in these Terms is intended to exclude or limit any consumer rights that cannot legally be excluded under the laws of the Republic of Indonesia.

We strongly recommend that all Guests obtain adequate travel insurance, including coverage for trip cancellation, accidents, medical treatment, and emergency medical evacuation.

8. Third-Party Service Providers

Some Services, including flights, accommodation, transportation, and liveaboard operations, are provided by Third-Party Service Providers.

We will make reasonable efforts to work with reputable providers. However, we cannot guarantee and are not responsible for the acts, omissions, delays, cancellations, negligence, or failure of any Third-Party Service Provider in delivering its services.

Third-Party Service Providers may apply their own terms and conditions, cancellation policies, refund policies, safety requirements, and limitations of liability.

By making a Booking, the Guest agrees to comply with the applicable terms and policies of the relevant Third-Party Service Providers.

9. Intellectual Property Rights

All content on the Website, including text, photographs, logos, graphics, designs, and other materials, is owned by Aha Bali Tour, Ahabali.com, or used with the permission of the relevant owner.

The content is protected by applicable copyright and intellectual property laws.

Users may not copy, reproduce, modify, distribute, publish, sell, or use Website content for commercial purposes without our prior written permission.

10. Data Privacy

We collect and process Guests’ personal information, including names, contact details, travel information, and Booking information, solely for the purposes of processing Bookings and providing the Services.

We are committed to protecting the confidentiality of such information and will not disclose it to unrelated third parties, except:

  • Where required by law;
  • Where required by a government authority;
  • Where necessary to process a payment; or
  • Where necessary to provide the Services, such as sharing relevant information with a hotel, airline, boat operator, driver, guide, or another Third-Party Service Provider.

We will take reasonable measures to protect personal data. However, no internet-based communication or data storage system can be guaranteed to be completely secure.

11. Use of the Website

  • Users must not use the Website for any unlawful purpose or in any way that may cause damage or harm to another party.
  • Users must not submit false or misleading information, interfere with the Website’s security, upload harmful software, or attempt to gain unauthorized access to our systems.
  • We reserve the right to restrict, suspend, or terminate a User’s access to the Website if the User violates these Terms.
  • We do not guarantee that the Website will always be available, uninterrupted, secure, or free from technical errors.
  • We reserve the right to carry out maintenance, updates, modifications, or changes to the Website at any time.

12. Reviews and Feedback

Guests may provide reviews, testimonials, photographs, videos, or other feedback regarding the Services.

By providing such content, the Guest grants us permission to display, reproduce, and use it on the Website, social media, or promotional materials, unless the Guest requests otherwise in writing.

We may edit a review for length, grammar, or formatting, provided that its original meaning is not materially changed.

13. Changes to These Terms and Conditions

We reserve the right to amend, modify, or update these Terms at any time without prior notice.

Any changes will become effective when published on the Website.

Continued use of the Website or Services after the updated Terms have been published will be considered acceptance of the revised Terms.

We recommend that Users and Guests review this page periodically.

The Terms that apply to a confirmed Booking will generally be the Terms in effect at the time the Booking Confirmation was issued, unless a change is required by applicable law or government regulation.

14. Governing Law and Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of the Republic of Indonesia.

Any dispute arising from or relating to these Terms, a Booking, or the Services will first be resolved through good-faith consultation and mutual discussion.

If no agreement can be reached, the dispute will be submitted to the competent court within the jurisdiction of the Province of Bali, Indonesia, subject to any mandatory consumer protection laws that may apply.
